Personal Injury Award in Missouri Auto Accident Must include Pain and Suffering

As Springfield Missouri injury and car accident lawyers, we recently learned of a case from the Eastern District Court of Appeals in St. Louis that reversed a trial court’s failure to award a plaintiff pain and suffering from a severe auto accident.  The Court of Appeals held that the trial court abused its discretion when it failed to award the plaintiff damages for his physical pain and suffering.  The Court did award medical bills and future medical care, but failed to award the pain and suffering for the car accident.  In Missouri, when the evidence is uncontested or overwhelming, the trial court must award something for injuries, disability, disfigurement and pain and suffering.  The Court of Appeals reversed and remanded the case back to the trial court for this auto accident in Osage County, Missouri.
