The Missouri Supreme Court will soon be deciding whether or not a writ of mandamus can judicially compel the Missouri State Treasurer to pay claims for the Second Injury Fund. Skirvin v. Treasurer, Case No. WD 75541. The Second Injury Fund is currently insolvent and legislative attempts to fix it have failed. It appears whether by judicial order or legislative action, injured workers in Missouri who qualify for disability under the Second Injury Fund will soon have an answer as to how to fix the Fund.
